1. Acceptance of these terms

These Terms of Service (“Terms”) govern your access to and use of enFoyer, the patient-communications platform operated by Tooth-Tastic Dental Clinic LLC (“enFoyer”, “we”, “us”). By accessing or using the service, you agree to be bound by these Terms. If you do not agree, do not use the service.

2. Definitions

• Service — the enFoyer dashboard, APIs, and related features used to manage patient communications.
• Clinic — a dental or medical practice that uses enFoyer to communicate with its patients.
• User — an individual authorised by a Clinic to access the Service.

3. The service

enFoyer enables clinics to receive and respond to patient messages over WhatsApp and related channels, and to manage appointments, reminders, and related communications. We may add, change, or remove features from time to time to improve the Service.

4. Accounts and eligibility

Accounts are provided to authorised clinic staff. You are responsible for keeping your login credentials confidential and for all activity under your account. You must provide accurate information and promptly update it as needed. You must be legally able to enter into these Terms.

5. Acceptable use

You agree not to:

• use the Service for unlawful, harmful, or fraudulent purposes;
• send spam, unsolicited messages, or content that violates applicable law;
• attempt to gain unauthorised access to the Service or its systems;
• interfere with or disrupt the integrity or performance of the Service.

6. Clinic responsibilities

Clinics are responsible for obtaining any consents required from their patients to communicate with them through the Service, for complying with all applicable laws and professional obligations, and for the accuracy and lawfulness of the content they send. Clinics remain the controllers of their patient data.

7. Third-party platforms

The Service relies on the WhatsApp Business Platform and other services provided by Meta Platforms, Inc. Your use of the Service must also comply with the applicable Meta and WhatsApp terms and policies, including the WhatsApp Business Messaging Policy. We are not responsible for the availability or actions of these third-party platforms.

8. Intellectual property

The Service, including its software, design, and trademarks, is owned by Tooth-Tastic Dental Clinic LLC or its licensors and is protected by applicable laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.

9. Fees

Any fees for use of the Service are set out in a separate agreement between enFoyer and the relevant clinic. Where no separate agreement applies, the Service is provided on the terms communicated to the clinic at onboarding.

10. Disclaimers

enFoyer is a communications and operational tool. It does not provide medical or dental advice, diagnosis, or treatment, and nothing in the Service should be relied on as such. The Service is provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law.

11. Limitation of liability

To the maximum extent permitted by law, enFoyer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising out of or related to your use of the Service.

12. Indemnification

You agree to indemnify and hold harmless enFoyer and its affiliates from any claims, damages, or expenses arising from your use of the Service, your content, or your breach of these Terms or applicable law.

13. Termination

We may suspend or terminate access to the Service if you breach these Terms or where required to protect the Service or comply with the law. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.

14. Governing law

These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. The courts of Dubai shall have jurisdiction over any dispute arising out of or in connection with these Terms.

15. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
